These Terms & Conditions apply to all estimates, orders, sales and installations arranged by Highland Carpets Limited trading as Simply Flooring (“Simply Flooring”, “we”, “our” or “us”). By accepting an estimate or placing an order with us, you agree to these Terms & Conditions.

1. Estimates

All estimates are based on the information available at the time of the site survey and current supplier prices.

Estimates remain valid for 30 days from the date of issue unless otherwise stated.

Whilst every effort is made to provide an accurate estimate, additional costs may arise where measurements or specifications change, additional materials are required, hidden site conditions are discovered, or supplier prices increase before materials are ordered.

Should any additional work or costs become necessary, these will always be discussed and agreed with the customer before work proceeds.

2. Orders

Acceptance of an estimate constitutes acceptance of these Terms & Conditions.

Materials will only be ordered once the customer has confirmed acceptance of the estimate.

Special order products cannot normally be cancelled once ordered.

3. Special Order Products

Products that are specially ordered, manufactured, cut to size or sourced specifically for a customer’s order cannot be cancelled, returned or refunded once ordered unless they are faulty, damaged on delivery or supplied incorrectly. This does not affect your statutory rights.

4. Colour, Shade & Product Variation

Samples are intended as a guide only. Natural variations in colour, shade, texture, pattern and finish may occur between samples and the finished product. Manufacturing tolerances and batch differences are normal and do not constitute a defect.

5. Natural Characteristics

Certain flooring products naturally display characteristics that are not faults, including carpet shading, watermarking, pile reversal, flattening through use, and variations in timber, vinyl and LVT products.

6. Site Conditions & Subfloors

Our estimates are based upon the visible condition of the property during the survey. Existing floor coverings often prevent a full inspection of the subfloor prior to installation.

If additional work is found to be necessary after removing the existing flooring, including damp, uneven floors, loose or damaged screeds, damaged timber floors, asbestos-containing materials, contaminated subfloors or additional preparation, these works are not included within the original estimate.

Any additional work and associated costs will be explained and agreed before proceeding.

7. Independent Flooring Installers

Simply Flooring supplies flooring products and can arrange installation by experienced independent self-employed flooring installers.

All installers operate as independent contractors and are not employees of Highland Carpets Limited t/a Simply Flooring.

Where installation is arranged through Simply Flooring:

  • The installation agreement is between the customer and the independent installer.
  • Installation, uplift, disposal and fitting charges are payable directly to the independent installer unless otherwise agreed in writing.
  • Simply Flooring acts only as an introducer and coordinator and does not collect fitting charges on behalf of the installer.
  • The independent installer is responsible for carrying out the installation in a professional and workmanlike manner.
  • Simply Flooring will assist in liaising with the installer to help resolve any genuine issues wherever reasonably possible.

Nothing in this clause affects your statutory rights.

8. Customer Responsibilities

Customers are responsible for ensuring:

  • Rooms are cleared of furniture unless otherwise agreed.
  • Appliances are disconnected where necessary.
  • The work area is safe and accessible.
  • Adequate parking is available where reasonably possible.

9. Payment

Payment for flooring products supplied by Simply Flooring is due before delivery or installation unless otherwise agreed in writing.

Installation charges are payable directly to the independent installer unless agreed otherwise.

Interest may be charged on overdue accounts at the statutory rate together with any reasonable recovery costs.

10. Delivery

Delivery dates are estimates only. Whilst every effort is made to meet agreed dates, Simply Flooring cannot accept liability for delays beyond our reasonable control.

11. Inspection of Goods

Customers should inspect all goods as soon as reasonably possible. Any shortages, damage or manufacturing defects should be reported immediately and, wherever possible, before installation.

12. Returns

Stock items may be accepted for return at our discretion and may be subject to a handling or restocking charge.

Special order goods cannot normally be returned unless faulty, damaged on delivery or supplied incorrectly.

13. Retention of Title

All goods supplied remain the property of Highland Carpets Limited until paid for in full.

14. Limitation of Liability

Nothing within these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability which cannot legally be excluded.

Subject to this, our total liability shall not exceed the purchase price of the goods supplied.

15. Complaints

If you have any concerns regarding goods or services supplied, please contact us as soon as possible. We are committed to resolving complaints fairly and promptly.

16. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
